If you are purchasing a property for the first time you probably have a number of questions relating to any potential purchase. The process of buying in Spain is straightforward provided you do things correctly. We will help you through the process to avoid any potential problems but to help you along the way here are some frequently raised questions.

How do I make sure my property is legal and has no debts?

It is important that you have the deeds (escritura) checked and that the necessary search (nota simple) is carried out to ensure that there are no debts on the property. We would recommend that you use a local solicitor that speaks good English in order to carry out this work. We work with a number of independant solicitors in Nerja and will be pleased to introduce you to one of them. The solicitor will also arrange change of utility accounts.

How do I go about getting an NiE number?

This number gets you into the system and is a required on the day you complete. It is necessary for you to apply in person at least 3 weeks prior to completing a purchase. This is a simple procedure but can be a bit daunting if you are new here. In this area it is necessary to apply in person at the Police station in Torre Del Mar again as part of our service we will take you there to make the whole thing easier.

What are the costs of buying?

You need to allow about 10%. 7% is the amount of the purchase tax (similar to stamp duty in uk) 1% for solicitors and the remainder for Notary Fees and for setting up a mortgage. If you do not need a mortgage the costs will be slightly lower.

Do I need a Spanish Bank account?

It is advisable as you will have utility bills etc to pay on your new home as well as making transfers to Spain for the purchase. Opening an account in Spain only requires yourself and a Passport. Again we can introduce you to a bank if this is required.

Do I need a Spanish Will?

Again this is advisable as although your uk will may be valid for Spanish assets it can be complicated and time consuming for your beneficiaries in the event of your death. The cost of making a will is relatively small and can be carried out by the solicitor at the time of purchase.

Do I need a survey?

The majority of people do not have surveys in Spain. This is mainly because the construction is very different to the Uk. In some cases you may still decide to have a survey particularly for new build country properties where there is concern about the land the property is built on. If a survey is required then this can be arranged.

What are the charges for the work you carry out?

We make no charge for the service our income comes from the fee the seller pays as an estate agency charge we do not charge the buyer.
